Lifehacker.com Wednesday, July 09, 2008California Can't Resist: Wants To Tax iTunes Downloads Again There are some states that already include a sales tax on internet downloads for things like iTunes purchases (even if the rationale for the tax doesn't seem to exist beyond "the state needs money"). Every so often various other state politicians start itching to add an iTunes download tax. The latest is California. Some state politicians made a bunch of news back in April for proposing just such a plan, but the resulting publicity and anger from California residents made sure that proposal was quickly shot down. So what did the main sponsor of that proposal do? He waited less than two months and proposed a nearly identical tax on digital downloads. Of course, all this will really do is push more people to look at alternatives, legal or not, because of the greater expense associated with digital downloads (a product that should get cheaper over time, rather than more expensive).

Lifehacker.com Wednesday, July 09, 2008Once Again: Do Not Send Legal Threats To Companies Because You Don't Like What A User Says It's getting to be rather silly how many times we've posted about section 230 of the CDA, which protects websites from the actions of their users -- but it seems that there's no shortage of folks with quick legal trigger fingers, who figure that anything they dislike online must be illegal, and they can blame the site that hosted it. The latest example, sent in by an anonymous reader, is that 800Notes, one of many websites that allows users to post notes on random callers (telemarketers and such) discovered that the owner of one company, mynutritionstore, whose phone number was listed on the site sent an angry threat demanding it be taken down, because someone had a negative experience with the company. When 800Notes told the owner of mynutritionstore that it would not remove the negative reviews, he apparently threatened to sue 800Notes. Public Citizen stepped in and sent him a quick legal lesson on the safe harbors provided by the CDA, how anti-SLAPP laws work and also pointed out Techdirt.com Wednesday, July 09, 2008Mixed Ruling In Case Over Limitations On DMCA Anti-Circumvention Clause John Stottlemire, who is being sued by Coupons.com in a case we've been covering, writes in himself to let us know that the court has ruled on various motions to dismiss (warning: pdf). If you don't recall, Coupons.com offers online coupons using some software. The software is designed to limit how many copies of a coupon each person can print, but Stottlemire figured out ways to easily get around that limit and both built a tool to do so, as well as explained how to do it manually -- at which point Coupons.com sued him for a DMCA violation, claiming he circumvented their anti-copying mechanism. The specifics of the case are pretty confusing, but basically Coupons.com is trying to stretch the DMCA beyond what it was intended for. The ruling dismisses some of Coupons.com's claims, while allows others to go forward.
