New documents obtained by ET show that Richard Heene, the father of the so-called "Balloon Boy," was granted a temporary restraining order against a Los Angeles man, in part because Heene claimed the man "eroneously (sic) reported [him] to the the Department of Children and Family Services." Richard and his wife Mayumi asked for protection from Matt Wineroth for themselves and their three children, Bradford, Ryo and Falcon, back in 2006. They claimed that Wineroth, who they called an "ex-employee," not only reported them to DCFS, but they also alleged that he and his partner Josh Chase had stolen a copy of a database from their production company, My You Me Productions. In papers, Richard Heene also alleges that Wineroth told him, "I'm going to kick your ass," and that Wineroth "stared at [him] intently as though he was going to do [him] physical harm."

Swiss court says Roman Polanski must stay in jail over fears he could flee country to avoid extradition to the United StatesThe film director Roman Polanski has lost his appeal to be freed from a Swiss prison.The federal criminal court said today that releasing the director on bail or under house arrest posed a flight risk. The director faces possible extradition to the United States for having sex with a 13-year-old girl in 1977.He was arrested on 26 September as he arrived in Zurich to receive an award from a film festival.'The court considered the risk that Roman Polanski might flee if released from custody as high,' the court said. 'The bail offered by the appellant does not meet in its form the requirements set out by the law.'Swiss legal experts have previously said Polanski's chances of release are minimal, as he is not Swiss and has already jumped bail. More court proceedings are expected after Washington files its formal extradition request, which it must do by late November.L

ET has obtained audio to a 911 call made by Richard Heene -- the father to the so called "Balloon Boy" -- where he claimed he was being threatened. During the call, made on August 6, 2009, Heene tells the 911 operator that he is suspicious of men working around his house following a threat he received. "There was a guy running around our house late last night, and this morning at 8:30 there were suspicious characters that were doing things that are just not conducive to what I know about construction. ... They just painted a line," he tells the operator. When asked who threatened him, Heene responds, saying, "It was a guy that works for another guy that cosigned a loan for me, on my vehicle."

ET has learned that the Federal Aviation Administration is investigating the so-called "Balloon Boy" incident involving Richard and Mayumi Heene. An FAA spokesperson tells ET: "We just launched the investigation so I can't speak about it until the investigation [is] closed. The investigation was launched within the last couple of days. We are looking at our own regulatory framework for violations. One size doesn't fit all as far as sanctions are concerned."
